By initiating the use of the Web Site you accept the following terms and conditions:

The Web Site is provided by Yab Yum Clothing Co. ApS, com-pany registration number 70 12 22 19, Birkemosevej 16, DK-6000 Kolding, Denmark, e-mail address web@gabba.dk (hereinafter referred to as ”Owner”).

2.    Proprietary and intellectual property rights
The Owner is the proprietor of numerous proprietary and intellec-tual property rights to the Web Site as well as the content and material accessible from the Web Site, including but not limited to:
Copyrights to designs, products, text, product information, lay-outs, images, typing, databases, audio and video sequences;
Registered and unregistered trade mark and feature rights to the “GABBA” word and logo as displayed on the Web Site;
Domain name rights to the domain name www.gabba.dk;
Design rights to the designs and products displayed at any time on the Web Site;   
(Copyrights, Registered and unregistered trade mark and feature rights, Domain name rights and Design rights are hereinafter re-ferred to as ”Proprietary and Intellectual Property Rights”).
The Owner may transfer, in whole or in part, the Proprietary and Intellectual Property Rights to third parties without prior notice and/or information to you.
By initiating the use of the Web Site you acknowledge the Pro-prietary and Intellectual Property Rights of the Owner.
You state that you at all time will observe and respect the Pro-prietary and Intellectual Property Rights of the Owner.

3.    Licence
The Owner grants you a limited right only to browse the Web Site and place orders in the web shop accessible from the Web Site.
Thus, you expressly acknowledge and agree that you are not permitted or allowed to download (other than page caching), for-ward, pass on, sell, lease, loan, lend, process, translate, modify, copy, produce, reproduce, market, duplicate and/or distribute nei-ther directly or indirectly, in whole or in part the Web Site, the content and/or material on the Web Site, hereunder but not lim-ited to the product information, designs, products, price lists, ac-count information, text, layouts, images, databases, audio and video sequences, names and/or logos without the prior written permission and consent of the Owner. This applies both in regard to your private as well as commercial use.
You acknowledge and accept that the Web Site, hereunder also the content and/or material on the Web Site in whole or in part may not by you, hereunder upon your instructions, be placed in frames on third party web sites (prohibition against framing).
You acknowledge and accept that you may not use any mega tags utilising the Owners Proprietary and Intellectual Property Rights, hereunder the GABBA name and/or logo as displayed on the Web Site.
You expressly acknowledge and accept that any unauthorized use of the Proprietary and Intellectual Property Rights, the Web Site, the content and/or material on the Web Site may form the basis of a claim for damages, remuneration and compensation on the part of the Owner.
By initiating the use of the Web Site you guarantee that you will at all-time comply with the legislation in force and that you will not in any manner initiate the use of or use the Web Site or any parts hereof for unlawful, amoral or otherwise illegal purposes.

4.    Access
The Owner will maintain and develop the Web Site to the best of its ability.
The Owner will endeavour to make sure that the content and ma-terial on the Web Site at any time is correct, up-to-date and in compliance with applicable law.
You accept that updates, changes, corrections and/or additions to the Web Site are made continuously and can be done without prior notice and/or your approval.   
The Owner explicitly disclaims any liability for the usability of the Web Site, the online applications and/or any other service pro-vided by means of e.g. the Web Shop on the Web Site, and that such may be used without any interruptions or failure, hereunder as a result of dropouts, power or technical failure, inaccuracy, state, and/or fitness for particular purposes.
Thus, the Owner is not liable for your future loss or any kind of indirect damages which may arise out of or in connection with your use or non-use of the Web Site.

5.    Links to third party web sites
The Owner may at its own discretion create hyperlinks to third party web sites.
Creation of such hyperlinks does not constitute the Owner’s ap-proval of the providers of such third party web sites and/or their products and/or services.
You acknowledge that the Owner has no control of such said third party websites and that the Owner cannot be held responsi-ble and/or liable for the content and/or material on such third party websites, hereunder e.g. for indecent, obscene, offensive, violent or otherwise inappropriate language, unlawful, amoral or otherwise illegal content and/or material.
The Owner reserves all rights to delete, at any time without prior notice to you and at its own discretion, any hyperlink to any third party web site or any programme, hereunder software.
You acknowledge and accept that your visits to third party web sites are at your own risk and of no concern to the Owner.

6.    Third party rights
The Owner does not guarantee that your use of the Web Site does not infringe a third party’s rights.
Consequently, the Owner is under no obligation to indemnify you in the event third party makes a claim against you as a result of your use of the Web Site.

7.    Electronic Newsletters
The Owner may from time to time issue electronic newsletters re-garding the business and commercial activities of the Owner.

You may subscribe to the electronic newsletters on the Web Site, however, conditioned on you accepting the Owner’s Personal Data Policy. See Clause 8 “Privacy – Personal Data Protection Policy”.

 
8.    Privacy - Personal Data Protection Policy
The Owner is under the obligation to observe the Danish Act on Processing of Personal Data.
The Personal Data Policy of the Owner is available for download at the Web Site.

9.    Governing Law and Dispute Resolution
These Terms of Use - Web Site are construed in accordance with and governed by the laws of Denmark.

Any dispute arising out of or from these terms or the interpreta-tion hereof which cannot be settled amicably shall be brought be-fore a Danish court applying Danish legislation in force at any time with the exception of Danish private law rules to the extend such would lead to the application of any other legislation than Danish.
